STUDIO 202 / TWUNKJUNK

PRIVACY, CONFIDENTIALITY & IMAGE USE AGREEMENT (UTAH)

This Agreement is entered into between Studio 202 / TwunkJunk, a Utah-based boudoir photography studio (“Studio”), and the undersigned client (“Client”). This Agreement is governed by the laws of the State of Utah, including the Utah Consumer Privacy Act (UCPA). By booking, participating in, or receiving services from Studio 202 / TwunkJunk, Client knowingly and voluntarily agrees to the following terms: The Studio may collect personal information including but not limited to Client’s name, contact information, payment details, communications, session preferences, photographs, video, audio recordings, and signed documents solely for the purpose of providing professional photography services, scheduling, billing, delivery of products, recordkeeping, and legal compliance. Studio 202 / TwunkJunk does not sell personal data, does not engage in targeted advertising, and does not disclose personal information except as necessary to perform services, comply with the law, or as expressly authorized by Client. All boudoir images and session content are considered highly sensitive and strictly confidential. The Studio shall not publish, distribute, display, or share any images or identifying information without Client’s express written consent. Image use authorization is strictly optional and declining consent does not affect pricing, service quality, or access to products. If Client authorizes image use, such authorization grants Studio 202 / TwunkJunk a non-exclusive, royalty-free license for the specific purposes selected by Client, including full use, limited or anonymous use, or no use at all. Client may revoke image use consent in writing at any time for future use only, and prior lawful use shall remain valid. Copyright ownership of all images remains the exclusive property of Studio 202 / TwunkJunk. Both parties agree to maintain the confidentiality of all non-public information, including but not limited to Client identity, images, communications, session details, and studio processes, and agree not to disclose such information to any third party without written consent unless required by law or court order. Unauthorized disclosure may cause irreparable harm and entitle the injured party to injunctive relief, damages, and any remedies available under Utah law. Studio 202 / TwunkJunk implements commercially reasonable safeguards to protect Client data, including secure storage, restricted access, and password protection. Images and personal data are retained only as long as reasonably necessary to fulfill contractual obligations, legal requirements, or upon Client’s written request for deletion where permitted by law. Client affirms they are at least twenty-one (21) years of age, possess full legal capacity to enter into this Agreement, and may be required to present valid government-issued identification. Utah residents have the right to request access to, deletion of, or copies of their personal data in accordance with the UCPA by submitting a written request to Studio 202 / TwunkJunk. Venue for any dispute arising from this Agreement shall lie exclusively in Salt Lake County, Utah, unless otherwise required by law. This Agreement constitutes the entire understanding between the parties regarding privacy, confidentiality, and image use and supersedes all prior discussions or representationsg.
